1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the AfterPit mobile application and any related services (together, the "Service"), provided by After Digital Pty Ltd (ABN 86 700 205 429) ("After Digital", "we", "us", "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
AfterPit is currently provided free of charge. We may introduce paid subscription tiers in the future; if we do, this document will be updated and you will be notified before any charges apply to your account.
2. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You must provide accurate information when creating an account and keep it up to date.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at support@afterpit.com.au if you suspect unauthorised access to your account.
- We support sign-in via email, Google, and Apple. If you sign in via a third-party provider, your use of that provider is also governed by that provider's own terms.
4. How Vehicle Records Work
AfterPit is built around the idea that a vehicle's service history belongs to the vehicle itself, identified by its Vehicle Identification Number (VIN), rather than to any individual user account. This section explains how that works and what it means for you.
4.1 Registering a Vehicle
A VIN is unique to a single physical vehicle. When you register a vehicle in AfterPit, you are asserting that you own or are authorised to manage that vehicle. The first account to register a given VIN becomes the vehicle's primary record holder in the app.
4.2 Accuracy of Information
You must only register vehicles you own or are authorised to manage. Registering a vehicle you do not own or do not have permission to manage is a breach of these Terms and may result in account suspension.
4.3 Ownership Disputes
If another user believes a vehicle in the app has been incorrectly registered to your account (for example, because they are the true current owner), they may submit a claim. We will notify you of the claim and may request supporting evidence of ownership (such as registration papers or a compliance plate photo) from either party. We reserve the right to reassign a vehicle record where we reasonably believe the evidence supports doing so. Our decision is made in good faith based on the information available to us; we do not independently verify vehicle ownership with government authorities and are not liable for errors arising from incomplete or false information supplied by users.
4.4 Transferring or Releasing a Vehicle
When you sell or otherwise dispose of a vehicle, you may release it from your account. Once released, the vehicle's history remains attached to the VIN and becomes available to the next account that registers that VIN. You should only release a vehicle once you have handed over the identification details (VIN) to the new owner.
4.5 Accuracy of Service History
Service history entries, including those created manually, imported via document scanning, or received from third parties (such as workshops), are user-generated and have not been independently verified by After Digital. We make no representation or warranty as to the accuracy, completeness, or reliability of any vehicle history displayed in the Service. Anyone relying on vehicle history shown in AfterPit, including for the purpose of buying or selling a vehicle, does so at their own risk.
5. Sharing Access to a Vehicle
You may invite other users to access a vehicle record in your account, with roles and permissions that we may make available from time to time (for example, co-owner or viewer access). You are responsible for managing who has access to your vehicles.
6. AI-Assisted Document Scanning
AfterPit offers a feature that allows you to upload photos or PDF documents (such as invoices or logbook pages) to automatically extract vehicle service information. This feature uses third-party artificial intelligence services, including models provided by Anthropic (Claude) and Google (Gemini), to process the content of documents you upload.
- You must only upload documents you own or have permission to share.
- Extracted information is presented to you for review before being saved — you are responsible for checking accuracy before confirming an entry.
- We are not liable for extraction errors, misreadings, or omissions produced by these third-party AI services.
- Uploaded documents are processed to provide this feature and are handled in accordance with our Privacy Policy.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Register vehicles you do not own or have no authority to manage
- Upload false, misleading, or fraudulent service records or documents
- Attempt to gain unauthorised access to another user's account or vehicle records
- Interfere with or disrupt the Service, including through excessive automated requests
- Reverse engineer, scrape, or attempt to extract the Service's underlying data or source code
- Use the Service to harass, defraud, or impersonate any person or business, including workshops
We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or misused the Service.
8. Subscriptions and Payments
AfterPit is currently free to use. We may introduce optional paid subscription tiers or one-off purchases (such as document scanning credits or history reports) in the future.
Where any purchase is made through the Apple App Store or Google Play Store, that purchase is also subject to the respective platform's terms of service, including their billing, refund, and cancellation policies.
9. Intellectual Property
The Service, including its design, features, branding, and underlying software, is owned by After Digital Pty Ltd and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended personal or business purpose.
You retain ownership of the content you upload (such as photos, documents, and vehicle information). By uploading content, you grant us a licence to use, store, and process that content solely for the purpose of providing and improving the Service. We will not sell your personal data to third parties.
10. Third-Party Services
The Service integrates with third-party providers to deliver certain features, including but not limited to:
- Vehicle registration lookup services
- AI document processing (Anthropic, Google)
- Cloud hosting and infrastructure providers
- Push notification services
- Payment processing via Apple and Google
We are not responsible for the availability, accuracy, or performance of these third-party services, and your use of features relying on them may be subject to those providers' own terms.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be lawfully excluded under the Australian Consumer Law.
12. Limitation of Liability
To the maximum extent permitted by law, After Digital's total liability to you arising out of or in connection with the Service, whether in contract, tort, or otherwise, is limited to the greater of:
- The total amount you paid to After Digital in the 12 months preceding the event giving rise to the claim; or
- AUD $100.
We are not liable for any indirect, incidental, or consequential loss, including loss of profits, loss of data, or loss arising from reliance on vehicle history information displayed in the Service.
13. Termination
You may stop using the Service and delete your account at any time via the app settings.
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or harmful conduct, or if required to do so by law.
On termination, your right to use the Service ends immediately. Vehicle records you have registered will follow the rules set out in Section 4 (vehicles remain tied to their VIN, not to your account).
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of Queensland, Australia.
If a dispute arises, we encourage you to contact us first at support@afterpit.com.au so we can attempt to resolve it informally. If a dispute cannot be resolved informally within 30 days, either party may pursue the matter in the courts of Queensland, Australia, which shall have exclusive jurisdiction.
